Terms of Service

These Terms of Service ("Terms") govern your use of the Mkufunzi POS website and platform provided by Mkufunzi ICT Solutions Ltd ("Mkufunzi POS", "we", "us"). By creating an account or using the service, you agree to these Terms.

1. The service

Mkufunzi POS is a cloud point-of-sale and business management platform. We offer optional modules covering payments, tax, payroll, accounting, and industry-specific features. Available features depend on your subscription plan.

2. Accounts and eligibility

You must provide accurate registration details and keep your login credentials secure. You are responsible for activity under your account and for the users you invite. You must be authorised to act for the business you register.

3. Subscriptions, trials, and billing

• Paid plans are billed in advance for the chosen period (monthly or annual).
• Free trials, where offered, convert to a paid plan only if you choose to subscribe.
• Fees are stated in Kenya Shillings unless otherwise shown and exclude applicable taxes.
• Unless required by law, fees already paid are non-refundable; you keep access until the end of a paid period.

4. Acceptable use

You agree not to misuse the service, including by attempting to disrupt it, access it unlawfully, or use it for unlawful activity.

5. Your data

You own the business data you enter. You grant us the limited rights needed to host and operate the service for you. Our handling of personal data is described in our Privacy Policy.

6. Tax and regulatory compliance

The platform provides tools to help you meet obligations such as KRA eTIMS invoicing and statutory payroll. You remain responsible for the accuracy of your records and for your own filings and remittances.

7. Availability

We work to keep the service available and reliable, but we do not guarantee uninterrupted or error-free operation. Any availability figures we publish are historical averages and do not form a service-level guarantee unless set out in a signed agreement.

8. Limitation of liability

To the extent permitted by law, we are not liable for indirect or consequential losses. Our total liability for any claim is limited to the fees you paid for the service in the three months before the claim arose.

9. Termination

You may cancel at any time; cancellation takes effect at the end of your current paid period. We may suspend or terminate access for breach of these Terms or non-payment, giving notice where reasonable.

10. Governing law

These Terms are governed by the laws of Kenya. Disputes are subject to the jurisdiction of the courts of Kenya, after a good-faith attempt to resolve the matter directly.

11. Changes to these Terms

We may update these Terms from time to time and will post the updated version here with a new "last updated" date.
